Court nullifies second Olympics injunction

For the past few weeks we have experienced Accra Great Olympics for the second time file for an injunction application preventing the 2017/18 Ghana Premier League season to begin as it was  dismissed by an Accra High Court on Thursday.

The court ruled that the case brought before them by the Accra-based club was beyond their jurisdiction, insisting it is an internal matter which Ghana Football Association judicial body must handle.

Olympics, who were relegated last season, applied for a second injunction pending an appeal to prevent the new league campaign from starting without them.

That was after the Disciplinary Committee of the GFA quashed their protest against Bechem United for fielding an unqualified player. Had Olympics won the protest, Bechem United will be docked points, essentially condemning them to relegation while Olympics are reinstated in their stead.

But the  Disciplinary Committee rejected the claim by Olympics on two counts saying the quest for boardroom points cannot be granted as the protest was out of time. The GFA rules state that a protest must be made within three days of the match being played but Olympics made their request seven months after the game.

Their petition was also thrown out because there is nothing like a petition in the federation’s laws in the quest for points.

The long drawn legal battle in the courtroom was initially ruled by Justice Anthony Yeboah, a justice of the High Court, who rejected the first application by Olympics for an injunction on the league.

The start of the 2017/2018 Ghana Premier League season was postponed for the second time following the second application of injunction by Accra Great Olympics. However, with today’s ruling, the league is set to commence.
